TERMS AND CONDITIONS OF USE

In these Terms and Conditions “we” and “us” means B. Abdallah Family Trust trading as Café Safi, the Website Owner, and “you” means you the customer or site visitor.

Please read the Terms and Conditions carefully before placing any orders on www.cafesafi.com.au

These Terms and Conditions together with your order constitute the entire contract between us and you for the supply of products. No other Terms and Conditions will apply. The contract may not be altered unless agreed to by us in writing or via email.

From time to time we may change the Terms and Conditions on www.cafesafi.com.au please make sure you have read our Terms and Conditions at the time of purchase.

OUR GUARANTEE

Café Safi aims to provide exceptional customer service to all its customers. We are determined to ensure you are very satisfied with your order. If you have any concerns or questions regarding your order, please email catering@cafesafi.com.au and we will endeavour to rectify the situation for you as soon as possible.

CURRENCY & GST

All prices shown are in Australian Dollars. On all Australian orders, Café Safi prices are inclusive of the 10% GST charge on purchases and a breakdown is provided within the checkout. We do not ship Internationally.

COLOURS

Please note that colours of products will sometimes vary depending on the quality and make of the computer systems or monitors they are being viewed on.

ORDER ACCEPTANCE

Once order placement has 7 occurred, you are engaged in a contract that sees you accept the prices and descriptions of the items you have ordered. Once an order has been placed with Café Safi, you will receive an email that your order is confirmed. This email confirms acceptance of the order. Please refer to ORDERING INFOMATION & PAYMENT INFOMATION section for further details.

ORDERING INFORMATION

You must create an account prior to placing orders on our website.

To login, click the account logo located on the top right of the page. For new customers please click ‘Create a new account’. For existing customers, enter your username and password and click ‘Sign in’. If you have forgotten your login details, please click ‘forgot password’ and you will be sent an email to reset your account.

Orders must be placed before 3.30pm, for next day delivery. A minimum spend of $50 AUD applies to each order placed. Once an order has been placed an email notification is sent to Café Safi. The Catering coordinator will then accept your order notifying you via email. At this stage you will be notified if we can accept to deliver (if it is within our delivery area) or you will need to collect the catering from our cafe. Only once you have this notification your order confirmed. If there are any questions regarding your order the catering coordinator will contact you by phone or email.

For last minute, same day orders or amendments to your current order please call us on (03) 9077 0633, and we will make every effort to accommodate your request. Late orders may not have the full choice of all menu items. Delivery may not be possible for late orders; customers will need to pick up from the café. Late changes or cancellation to existing order may not be accommodated, we will assess on a case by case basis.

Are Tracking Numbers Issued? – No

How can I track my order? – For online orders, once your order has been processed you will receive an email confirming details of your order. Alternatively you can login into your account to see the order history, call the café on 03 9077 0633 or email on catering@cafesafi.com.au.

PAYMENT INFOMATION

During the ordering process you may choose to pay by credit card or receive an invoice to be paid via bank transfer (ie. via your accounts payable department). If you have opted to pay by credit card, your card will only be charged after your order has been delivered. Credit cards accepted are MasterCard, Visa, Diners, AMEX.

For bank transfer, payment must be made within 14 days. A remittance advice must be sent to accounts@cafesafi.com.au once the bank transfer has been made. Also include the invoice number(s) in the description field.

Bank transfers are made to: B. Abdallah Family Trust trading as Café Safi Bank: CBA BSB:  063 000 ACC: 1446 5348.

Payment can also be made via EFTPOS and cash in store, please bring your invoice with you.

If we are unable to obtain authorisation for payment or in the case where we may suspect fraudulent use of credit card – we reserve the right not to accept your order. We also reserve the right to not accept your order if delivery address falls outside of our delivery area, or if the item ordered is out or stock or withdrawn from sale for any particular reason.

All credit card transactions on Café Safi online are processed using Paystream, a secure online payment gateway that encrypts data obtained from customers using Ingrian Devices to provide the highest level of protection available. Ingrian devices provide tamper-resistant protection of cryptographic keys to ensure encrypted data is kept private and secure.

DIETARY REQUIREMENTS

Café Safi can accommodate most special dietary requirements but do need to be given advance warning. You can note the dietary requirements in the free text fields when you are placing your order online. Additional fees may apply to accommodate this request. All dietary specific items will be plated separately and labelled accordingly. Please speak to our Catering Coordinator should you have a specific dietary requirement.

PRESENTATION

Catering will be delivered on boards and platters which are the property of Café Safi. We will come back and collect the boards and platters the same day or next business day. Lost or damaged equipment will incur a fee at retail prices for its replacement. Napkins can be provided upon request with no additional charge.

INFORMATION ON THE WEBSITE

Café Safi aims to keep content as up-to-date and accurate as possible. Café Safi makes no representation, whether express, implied in law or residual, as to the sequence, accuracy, completeness or reliability of the information contained in the website. Café Safi does not accept responsibility for any errors, or omissions in the site contents, although, Café Safi will be pleased to correct any errors displayed on our web pages if advised of them. Café Safi reserves the right to change or discontinue any aspect or feature of this website. Café Safi intends to use royalty-free material for the site and not to use any copyrighted material. If this occurs, we will remove it. Café Safi does not accept any liability for any loss or damage suffered (directly or indirectly) by making use of the site’s information. Nor can we guarantee that pages will display correctly in all web browsers or that the website will be online at all times. We cannot accept responsibility for events publicised on our site and we advise anyone planning to attend at an event listed to recheck details. Café Safi cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may happen when accessing this website. With any Links posted, the onus is on the visitor and Café Safi is not responsible in any way for any of their contents.

LEGAL CAPACITY TO TRANSACT

If you are under the age eighteen (18) years you CANNOT place orders with Café Safi. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Should Café Safi suffer any damage or other losses as a result of a transaction entered into by a minor, Café Safi reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Café Safi.

OUR LIABILITY

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any products supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the products(s) in question.

CREDIT CARD FRAUD

Whilst Café Safi employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Café Safi will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an un-authorised manner.

FORCE MAJEURE

Café Safi shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Cafe Safi and shall be entitled to a reasonable extension of time for the performance of such obligations.

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia and shall be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.

OTHER TERMS

Our website is provided in the state of Victoria, Australia and conditions of use are subject to Australian law which governs this User Agreement. We do not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances beyond of our control.
